MICHIGAN: A DEFENSE TO NOT PAYING SUPPORT?: I’M UNABLE TO BAY versus IT’S IMPOSSIBLE TO PAY

Interesting news tidbit coming out of Michigan’s Supreme Court involving defenses to child support enforcement:  NCPs now have a defense against child support enforcement–that they cannot pay child support; but it just better be because it is impossible for them to pay, i.e., the NCP has exhausted all resources from which to support his or her child and therefore cannot pay and should not be held in contempt.
